Sent by 'My Messages' in HSBC Online banking 21/01/2007 Dear Sir/Madam, I am writing to you today in relation to the fees due to be applied to my account on the 5th of February 2007. I am contacting you in this way in the hope that HSBC will maintain their level of Customer Service and will not require me to enter into months of correspondence to bring this issue to an end. I believe that the charges due to be levied on my account are punitive and thus are not enforceable under current UK laws. I am requesting today that you please overturn the charges, I am willing to pay a reasonable amount to cover costs incurred by my entering into an unauthorised Overdraft (by the amount of 4.98) however I do not believe that the charges due to be applied represent this. I am aware that the charges are laid out in the Accounts terms and conditions, however this does not make them legally enforceable, as you are no doubt aware no contract can overturn your legal rights. I hope that this matter can be settled quickly and to the satisfaction of both myself and yourselves. I sincerely apologise for the fact that I have passed my overdraft limit, however as you may expect I am going through a tough financial stage at this time of year and these charges would only serve to worsen this fact. So far I have had a good relationship with HSBC over the years that I have been banking with you, however I am more than prepared to seek legal action in order to recover money that is unlawfully removed from my account.
